Terms of Service

1. Acceptance of Terms

By accessing or using Matchly TCG ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Platform.

These Terms apply to all users, including visitors, registered users, buyers, sellers, and tournament organizers.

2. Definitions

Platform: the Matchly TCG website and associated services at matchlytcg.com.
User: any person or entity that accesses or uses the Platform.
Seller: a user who lists Trading Card Game (TCG) products for sale.
Buyer: a user who purchases products through the Platform.
Card(s): Trading Card Game collectible cards listed on the Platform.
Content: text, images, listings, descriptions, and other materials posted on the Platform.
Trade Proposal: a public request, posted by a user within a participating store, to acquire ("want") or dispose of ("have") a card or item in exchange for store credit.
Trade: a player-to-player exchange of cards settled in store credit and facilitated by a participating store.
Store Credit: a non-cash balance, denominated in Brazilian Real (BRL) and issued by a participating store, that may be used to settle trades within that store.
Guest Player: an account created by a store on behalf of a participant so they can join tournaments or trades before registering themselves.

3. Eligibility

To use the Platform, you must:

Be at least 13 years of age.
Have the legal capacity to enter into binding contracts.
Not be located in a jurisdiction where use of the Platform is prohibited.
Not have been previously suspended or removed from the Platform.

If you are under 18, you represent that you have obtained parental or guardian consent.

4. Account Registration

You must provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
A store may create a guest player account on your behalf to enroll you in tournaments or trades. If a guest account is created for you, you may claim it by registering, and you are responsible for keeping its information accurate once claimed.

5. Marketplace Rules

5.1 Listings

Sellers must provide accurate descriptions, condition grades, and prices for each card listing.
Listed cards must be physically owned by the seller at the time of listing.
Prohibited items include counterfeit cards, proxies not clearly marked, and non-TCG items.
All prices must be in Brazilian Real (BRL) unless otherwise specified.

5.2 Transactions

Buyers agree to pay the full listed price plus applicable shipping and fees.
Payment processing is handled by Stripe. By making a purchase, you agree to Stripe's terms.
Sellers are responsible for shipping cards within the timeframe specified in the listing.
Matchly TCG acts as a marketplace intermediary and is not a party to the sale contract between buyer and seller.

5.3 Fees

Matchly TCG charges seller fees as a percentage of each completed transaction.
Fee rates are displayed during listing creation and may be updated with 30 days' notice.
All fees are inclusive of applicable taxes.

5.4 Disputes

Buyers and sellers should attempt to resolve disputes directly first.
If a dispute cannot be resolved, Matchly TCG may mediate at its discretion.
Matchly TCG reserves the right to issue refunds, credits, or adjustments in case of fraud or platform errors.

5.5 Tournament Entry Fees and Refunds

Tournament entry fees are paid through the Platform and processed by Stripe at the time of registration.
If a tournament is canceled by the organizing store or by Matchly TCG, registered players are refunded their entry fee, less the amounts described below.
The payment processing fee charged by Stripe is non-refundable and is not returned as part of any refund.
Matchly TCG retains a service fee of 1% of the transaction amount to cover platform operating costs; the remaining amount is returned to the player.

5.6 Card Trading

Card trades are conducted between players within a participating store and are settled in store credit, not cash.
A Trade Proposal states whether the user wants to acquire ("want") or dispose of ("have") an item, the item requested, the quantity, and the store credit amount offered or sought. Other users may respond with Trade Offers.
A trade is executed only when both players, and the store where required, accept the terms. Once accepted, players commit to completing the exchange.
Players must physically own and deliver the cards they trade, in the condition described. Counterfeit cards and unmarked proxies are prohibited.
Matchly TCG facilitates trades as an intermediary and is not a party to the trade agreement between players or with the store.

5.7 Store Credit

Store credit is issued by the participating store, denominated in Brazilian Real (BRL), and is valid only within the issuing store.
Store credit has no cash value, is non-transferable between stores, and cannot be redeemed for cash unless required by law.
The issuing store is responsible for honoring store credit balances. Matchly TCG records balances on the store's behalf but does not guarantee their redemption.
Expiration, minimum amounts, and other store credit conditions are set by the issuing store and disclosed at the time of issuance.

6. User Conduct

You agree not to:

Violate any applicable laws or regulations.
Infringer on intellectual property rights of others.
Post false, misleading, or deceptive content.
Manipulate prices, rig auctions, or engage in shill bidding.
Harass, abuse, or harm other users.
Attempt to gain unauthorized access to our systems.
Use automated tools (bots, scrapers) without our express written consent.
Circumvent payment processing systems or fee structures.

7. Intellectual Property

7.1 Platform Content

The Matchly TCG name, logo, design, code, and platform features are proprietary to Matchly TCG. You may not reproduce, distribute, or create derivative works without our express permission.

7.2 User Content

By posting content (listings, images, descriptions) on the Platform, you grant Matchly TCG a non-exclusive, royalty-free, worldwide license to display, store, and distribute that content solely for operating and promoting the Platform. You retain all ownership rights to your content.

7.3 Third-Party IP

Trading Card Game cards are intellectual property of their respective owners (e.g., Wizards of the Coast, Pokémon Company, Konami). Users may list genuine cards for sale, but may not use third-party IP in a way that suggests endorsement or affiliation.

8. Payments and Fees

All payments are processed securely through Stripe.
Stripe handles payment authorization, processing, and settlement.
Sellers must complete Stripe Connect onboarding to receive payouts.
Payouts are sent to the seller's linked bank account according to Stripe's schedule.
Buyers may be charged applicable taxes (e.g., ICMS, ISS) based on their location.
Matchly TCG is not responsible for Stripe service interruptions or errors.

9. Shipping and Returns

Shipping terms (cost, carrier, timeframe) are set by the seller in each listing.
Buyers should review shipping details before purchasing.
Returns are handled between buyer and seller. Matchly TCG may facilitate return resolution in case of disputes.
Sellers must ship within the stated timeframe or issue a full refund.
The seller is responsible for the card until proof of delivery is provided to the buyer. We recommend using insured shipping.

10. Limitation of Liability

To the maximum extent permitted by law, Matchly TCG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount of fees paid by you in the 12 months preceding the claim.

Matchly TCG is not liable for the actions of sellers, buyers, or other users. The Platform is provided "as is" without warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

11. Termination

You may terminate your account at any time by contacting support.
We may suspend or terminate accounts for violation of these Terms.
Upon termination, your right to use the Platform ceases immediately.
Sections 7 (Intellectual Property), 10 (Limitation of Liability), and 12 (Governing Law) survive termination.

12. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be resolved in the courts of Recife, PE, Brazil.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or platform notice. Your continued use after the effective date constitutes acceptance of the new Terms.
